TALK PROGRAMME ON NEPALI HUMAN RIGHTS IN NEW YORK

Advocate Dinesh Tripathi address the gathering of National Lawyers guild of New York chapter. On the occasion he spoke that---there is total non-existent of rule of law in Nepal. Although constitution is not formally with- drawn but it is totally violated and disregarded. There is massive violation of human rights law and International humanitarian Law from both sides. State has became arbitrary and there is state sponsor terrorism. King has no intention to restore democracy and peace that's why he totally disregarded and did not responded or reciprocated the cease fire declare by Maoist. Security forces is working with full impunity and without any accountability's. Death, disappearance and torture has became daily routine of the Nepali life. There is harsh censorship impose on the media. Black law have been introduce to suppress media freedom guaranteed by constitution. There is frequent mid-night attack on community radios which are ( FM ) the quickest source of information for common people. Economic blocked has also been impose on media. Journalist are facing frequent threat from the both sides. Several journalist have been arrested by government and killed by Maoist. Although political parties are not formally banned but they have been marginalinalize by king and without representation of valid party cabinet had been constituted under his own chairmanship which is blatant and clear violation of constitution. In the cabinet people who have no mass base and people who have been convicted by court had been inducted in the cabinet. Without people's support and popular legitimacy king is running a government which is the clear disregard of the cardinal principle of democracy that "No taxation without representation." Notion of independence of judiciary is also massively undermined. Court system is also working under the shadow of militarization. There is non-compliance with court order and court have been packed by pro-king people. Court is no longer able to uphold the supremacy of the constitution and liberty and dignity of the citizen.

In this critical and most critical juncture of our history and we need a active support and solidarity of International community. Struggle of human rights is global one and it is global issue. Violation of human rights and freedom is in one country should be considered the threat against all people and all nation. But Nepal has became a kind of forgotten country. International civil society and community must play a active role to establish a human rights and democratic peace in Nepal. International legal action is the need of the our in Nepal because national mechanism is failed and became ineffective to protect peoples rights and failed to made the human Right violator accountable. International criminal court must take up and it must be allow to assume it's jurisdiction on Nepal so massive violator and perpetrator of human rights could be face trial and impunity could be ended. International community can work in this issue.
