Reviving The Constituent Assembly


There might not be a legal, constitutional option to revive the CA. But there might be a political option, a revolutionary option.

Is CA Revival Possible?

For the longest time in 2005 I argued there was no option to revive the parliament. But the parliament was revived in 2006. So maybe the politicians in Nepal know something I don't know. Perhaps the CA can be revived. If it can be, then that might be the best option.

Considering the Maoists have vertically split and the Baidya-Badal group has somewhere between 108 and 115 members in the last assembly, Baburam might be duly ousted as PM. It is curious to me though as to how Vaidya can support Koirala but not Baburam. Baburam is not left enough for Vaidya, but Sushil is?

The best part of reviving the CA is due process will come back on track. The CA can pass all election related ordinances. It can duly oust Bhattarai. The UCPN(M) and the Madhesi parties on their own do not have half the strength, do they?

So if all agreed upon issues can be codified, and all election related ordinances can be passed, and Baburam Bhattarai can be ousted through a no confidence motion, and a new government can be duly elected, and the country can move towards new elections then the option to revive the CA has to be looked at.

What if the CA is revived through political consensus and the Supreme Court declares it null and void? Then the CA will have the option to wash away the entire Supreme Court with two-third decision. Impeach all judges at once.

I am for reviving the CA, if that is an option. That is a no brainer. Of course it would be great to have the CA back. It is a duly elected body.

The parties have had a hard time agreeing on a consensus prime ministerial candidate. But they can perhaps agree to revive the CA. If they can come to that consensus they can say so to the president and perhaps the CA can be revived.

This feels like resurrection. It is a biblical concept.

In a revived CA Vaidya would be leading the third largest party, ahead of the UML.

FDRA proposal for consensus
As per the third option floated by the senior leaders, a new constitution should be promulgated from a revived Constituent Assembly (CA) by accommodating the issues that have already been resolved and then the new govenrment should be formed under the leadership of the opposition party...... "A new government led by opposition party will conduct elections for the CA or parliament that will resolve the remaining issues of new statute," Singh told about their proposal. ...... According to the fourth option floated by the leaders, a national consensus government can be formed under the leadership of an independent person comprising political parties. ...... The meeting concluded that the CA must be revived even if political parties want to go for CA polls. "We should not go for polls by removing constitutional hurdles [through the president]," Singh said, adding, "Revival of the CA even for announcing new polls is the safest way."

Then UCPN (Maoist) leader Mohan Baidya split the party after it adopted "peace and constitution" as the party´s line against his demand for a "people´s revolt". .... around 100 representatives will participate from India, Europe, America and other parts of the Asia. A total of 44 central committee members and 30 central advisory committee members will participate in the general convention as organizing committee members. .... The party has completed conventions of the village, municipal and district levels. Bhusal informed that the state committee conventions will be completed by 1 January. .... Both UCPN (Maoist) and CPN-Maoist had announced their convention dates after the split. UCPN (Maoist) general convention scheduled for February 2, 2013 is overdue for two decades. Pushpa Kamal Dahal has been leading the party since the 1992 general convention held in Chitwan.

While rejecting the conditions set by Prime Minister Baburam Bhattarai for handing over government leadership to the party .... Koirala also warned of stringent protests if there was no consensus through negotiations. He asked all the regional presidents to be ready for election, fresh protests against the government and the challenges ahead. ..... Bhattarai has already floated a proposal to nominate Dahal as the next prime ministerial candidate from the party if the NC and UML refuse to join the present government for a brief period..... But he will be termed anti-federalist if he proposes Koirala and will also be blamed for throwing out a government of his own party. The Bhattarai faction has been projecting Koirala as anti-federalist all along. ..... The president will only nominate a new prime minister in accordance with Article 38(1) of the Interim Constituent, i.e. at the recommendation of the political parties.

Baburam 10 Times More Qualified Than Sushil



This is strictly talking in terms of personal qualities. Baburam is the obvious democratic choice as a duly elected PM and the choice of the largest party in the last elected assembly in the country, and the face of the largest political alliance in the country today. But that is not what I am talking about here. Sometimes what happens is a super qualified person does not get the top job because that person might be in some small party, as in the case with Nitish Kumar in India. The guy is the most qualified to be the next PM of India, but his party is rather small.

Based on personal qualities Baburam is 10 times, at least 10 times, more qualified than Sushil to be PM. Even Girija was better than Sushil. And Girija never struck me as the smartest kid on the block.

Baburam is more qualified than Prachanda to be PM. He is more qualified than Mahantha Thakur. Although Mahantha Thakur is more qualified than Sushil. If the NC were not an anti Madhesi party, Mahanthan Thakur not Sushil would be party president of the NC today.

On that note Baburam is also 10 times more qualified than Bijay Gachhadar.

I don't understand why the NC is pushing the Sushil Koirala name. The guy is not more qualified than Baburam for the job. I have been watching him run his party. He has not been doing a good job. If he were to be made PM right away I think he is sure to bungle the elections that are supposed to happen in April 2013.

Beyond The Three Parties


I don't see how it is possible for there to be national consensus if the Madhesi Morcha, the Badal-Baidya group of Maoists, and the Upendra Yadav led front are not taken into confidence. National consensus is not just the NC, the UML and the Prachanda-Baburam group of Maoists.

Prachanda and Baburam might agree to the Sushil Koirala name but if the NC will not accept the Badal name why would Badal-Baidya accept the Sushil Koirala name? If the NC will not accept the Mahantha Thakur name, why will the Madhesi Morcha accept the Sushil Koirala name? And Upendra Yadav is a legitimate candidate himself. He symbolizes the Madhesi Kranti like few other individuals.

If Prachanda is willing to accept Sushil Koirala as PM when Prachanda's party is bigger than that of Sushil, then why is Sushil not willing to accept Mahantha Thakur even though the Madhesi Morcha is smaller than the NC? Or at least was in the last election. That is a valid question.

A new force will emerge in Madhes
My two primary interests are reading and writing. I especially enjoy biographies and autobiographies. I recently finished Deng Xiaoping’s biography written by his daughter. I’ve also started reading Kissinger’s biography. ..... Institutionally, except the Constituent Assembly (which was an exception), Madhesi representation has never been above 20 percent...... In the judiciary, it’s below five percent, and in the Police/Army, it’s below one percent. The Dalit presence in all institutions is negligible and the story of Janajatis is similar..... The situation in Nepal is similar to that of Pakistan around 1947-1950, when 20 percent of the population (Punjabis) dominated at the expense of the Sindhi, Balochi and Pashtun. ...... The next elections will show new trends in the Madhes. New polarisation is underway. A new force to represent the Madhes will emerge. ..... A new Madhesi political force will emerge. There are three or four sides to this new formation. The militant forces in the Madhes, currently in negotiation with the government, are not in the mood to continue with an armed movement. The attraction for the Maoists among Madhesis is dwindling; today Madhesi members in that party are threatening to not participate in their general convention. Disenchanted Madhesis in the UML also did not join Ashok Rai’s party. Moreover, the 11 percent of the vote the Madhesi parties got in the last election will not go back to the Nepali Congress because of that party’s anti-federalist position. ...... The new census is out. It says that literacy rates in the Madhes are among the lowest in Nepal, comparable to the remote mountain district of Humla. ...... Bijay Gachchadar has become minister 11 times but look at the literacy rate in his district—it’s abysmal. ..... can’t condemn migration to the Madhes. We have to think about shared rule with Pahadeys in the Madhes. .... The old agenda was focussed on rights advocacy, the new one will focus on development advocacy.

Bhattarai has been pressing Dahal not to agree to change the present government until the party’s convention. The Bhattarai faction of the party is of the view that as it will take more than one month to complete all election related arrangements, government leadership will be handed over to the NC only after that. ...... Dahal is not in a position to force Bhattarai to quit in view of the fast approaching convention. .... an informal meeting of NC office bearers and influential central committee members, has concluded that Bhattarai is a hurdle to consensus.

NC could accept UCPN (M)'s latest proposal: Deuba
NC could be given government leadership if parties agree to fix a date for CA election and and make appointments to constitutional bodies, including the Election Commission and the Commission for Investigation of Abuse of Authority.
The most important thing is that elections be held in April 2013. I am glad we are about to see some movement to that end.

The all party government under Sushil Koirala has to be an attempt to bring together all the major political forces in the country. That would include the two Maoist parties, and the Upendra Yadav led front. So, all the parties in power right now, plus the Congress and the UML, the breakaway Maoists and the Upendra Yadav front.

चुनावको टुंगो छैन, आयोगले तयारी थाल्यो
'आयोगले वैशाखमा हुने चुनावमो पूर्व तयारी गर्दैछ,' निर्वाचन आयुक्त डा. अयोधीप्रसाद यादवले ईकान्तिपुरसित भने, 'सरकारबाट हामी (आयोग) आश्वस्त छौं । चुनावको आधारभूत पूर्वाधार निर्माण भइरहेको छ ।'..... 'निर्वाचन गराउन संविधान, ऐन, कानुन समयमै संशोधन भएर आउनु पर्छ,' आयुक्त यादवले भने, 'करिब एक महिनाभित्र आयोग पदाधिकारीविहीन हुनेछ भन्नेबारे सरकार र दलहरूलाई जानकारी छ । आयोगमा पदाधिकारी नरहे कुनै पनि चुनाव हुनसक्दैन ।' ..... आयोगले यसअघि नै संविधान तथा ऐन कानुनका संशोधन हुनुपर्ने बुँदा किटान गरी सरकारलाई बुझाइसकेको छ । त्यसैगरी आयोगका कार्यवाहक प्रमुख निर्वाचन आयुक्त दोलखबहादुर गुरुङ र आयुक्त यादवको पदावधि आगामी पुस २६ गते पूरा हुनेछ । आयोगका पाँच सदस्यमध्ये तीन सदस्यको पद रिक्त छ ।
