Army Under Parliament, Now


We don't have to wait for a constituent assembly and peace talks with Maoists and a new constitution to get the army totally under the parliament. The seven party alliance has enough votes in the parliament to amend the constitution fundamentally. It needs to take care of this detail. Now.
Army men kill 6 civilians in Morang NepalNews Royal Nepalese Army (RNA) soldiers have shot and killed six innocent civilians and wounded two dozen others in Belbari area of the eastern district of Morang. RNA solders sprayed bullets on the local residents who had gone to protest in front of the security base camp in Belbari this afternoon after army men allegedly raped and killed a 22-year-old local girl, Sapana Gurung, last night ...... the Ministry of Defence (MoD) in a statement this evening confirmed the death of six civilians but claimed that the security forces opened fire in self-defence as the crowd turned violent and tried to vandalise the security post...... The MoD said six persons were killed on the spot while 11 others were injured in the incident.
This case has to go to a civilian court. The soldiers who raped and killed Sunita Gurung need to be brought to civilian justice. And an inquiry has to be made into the details of the shooting incident. Looks to me like some soldiers will end up in civilian court also on this count.

This incident is of huge symbolic importance. It is for the SPA to show it is now in control.

The Army is willing to work with any government and it would continue to be answerable to Prime Minister and the Defence Minister, he said.

It is not for the army to decide if it will merge with the Maoists or not. The army is not an autonomous institution.

The parliament has to bring the army fully under its control. After it does that, it might as well order that army to wage a war on the Maoists. Who knows? I hope not, I think not. But the parliament has to have that option open, otherwise the army is not yet under the parliament. We will know that much.

And should there be integration, it will not be for the army to decide which Maoist soldiers they will take, and which they will not. It will be for the civilian government to decide on the framework.

After the parliament brings the army totally under its control, the seven party government will have several options. It could hire, fire, promote and demote individuals in the army. It could order the army to wage war on the Maoists. It could order it to declare a ceasefire. It could later order the command of the army shifted to the UN temporarily, if peace talks might thus warrant. It could even order the army dismantled.

That is what it means to have civilian control over the army.

The seven party government has the option to conduct extensive investigations to identify individuals guilty of human rights violations so as to bring them to justice. And you can do that without demoralizing the entire institution.

I am glad for it. There are many people who share their sentiment that a constituent assembly is the bottom line. I doubt anyone in the seven party alliance will disagree. But a continued blockade would have been against the spirit of the people.

We have emphasized that:

“The government of King Gyanendra must be directly held accountable for the atrocities committed by the Nepalese security forces against the unarmed protestors, as well as other gross and systematic human rights violations, repressive laws and restriction on basic freedoms imposed since 1 Feb. 2005.”

We also called upon the Seven Party Alliance and the Communist Party of Nepal-Maoist (CPN-M) to immediately declare a nationwide ceasefire and pursue a just resolution of the armed conflict through dialogue and political settlement and Seven Party Alliance to fulfill its six-point Joint Declaration for a United Effort to Resolve the National Crisis brought out on 8 May 2005, which speaks about their road-map towards democracy and peace.

It was a mistake that the Maoists were not consulted before the seven party alliance went ahead and accepted the king's decision to reinstate the parliament, but it was not a big mistake. But then does the SPA even have the phone numbers of the Maoist leaders? My impression is phone talk with the Maoists is one way traffic. They call, and that is when you talk. After the king's address, did the Maoist leaders make attempts to call up the SPA leaders? If not they should not be peeved that they were not consulted.

I don't have the slightest doubt in my mind that the 12 point agreement has made the progress thereafter possible. And it was the Maoists who took the lead on that one. The 12 point agreement stands out in the past half century of Nepali history. There is not another document in the same league.

I am very willing to give generous credit to the Maoist leaders. I want to give credit where credit is due. I am eager to do so.

The First Major Revolution Of The 21st Century Happened In Nepal

And no, I don't fear the Maoists are trying to use the seven parties to finish off the king so they can then turn on the seven parties and finish them off and then declare a communist republic. I really do believe the Maoists want a democratic republic. That is what they want with or without the seven parties. That is what they have ended up with after analysing many things like the current socio-economic status of the country, among other things. That is not a position of compromise for them. That is their first choice option.

Friday is when the parliament meets. The SPA needs to form a seven party government immediately. And the first decision that parliament should take on its first day is to decide formally to go for a constituent assembly. I wish the Maoists had called off their blockade immediately. But since they have not, I urge them to do so after the constituent assembly elections are declared formally.

There we have to find a new meeting point between the SPA and the Maoists.

The Maoists are committed to a democratic republic. So am I. So is Hamro Nepal. (Hamro Nepal, Latest) The Maoists are committed to a constituent assembly, so am I.

I am for dismantling both the armies. I don't know where the Maoists or the SPA stand on that one.

We democrats have to do all we can to build confidence, build trust between us and the Maoists. If they want phone calls, give them phone calls. If they want to be consulted before the SPA makes important decisions, consult. There is no harm in consulting. Why only Maoists? Consult widely. As widely as possible. Talk extensively and regularly before the formal peace talks.

Don't Forget The Dead And The Injured

There is an urgent need to set up a Martyrs Fund with a bank account number that gets made available to the Nepalis worldwide. These martyrs made the ultimate sacrifice. There is no compensation possible. But we have to try our very best. Their families need to be supported to the fullest. Many of them have left wives and kids behind.

Human Rights Abuses

Neither the RNA nor the Maoists ever formally endorsed violation of human rights. One option would be to set up a commission to bring specific individuals to justice.

Another option is to set up a Truth And Reconciliation Commission. You don't necessarily go and punish, but you do document all atrocities. You do allow all the aggrieved to be heard.

And there are various combinations of the two approaches that are possible.

I defer to the seven party alliance government on the details. It is for them to decide as to exactly what.

This is not right. The seven party alliance worked out a 12 point agreement with the Maoists by making a constituent assembly also part of their agenda. That is the meeting point. Now the seven party alliance has worked out the first step. This is a good thing, the first step towards a constituent assembly. This first step also was part of that 12 point agreement.

There was no formal alliance between the SPA and the Maoists, the 12 point agreement is an understanding. The April 6-9 program was a SPA program. The Maoists supported it from outside, and once it really took off beyond the wildest imagination of the SPA and the Maoists, both rushed to take credit. The BBC interviews of Girija and Mahara on the 10th were the high point of that tussle.

But now the program has been called off by the SPA, and that is it. The SPA is on to its victory rally, and the Maoists are going to have to call off their blockade, or they would be blockading the government of the seven party alliance. And if that happens, the SPA will rightfully break up with the Maoists.

The Maoists are about to spoil the broth. They should not do it.

The king has formally endorsed the SPA roadmap. He has formally endorsed the constituent assembly idea. The SPA did not ask for anything else. The SPA has not abandoned the 12 point agreement.

I hope the Maoists are not out to prove Moriarty right. Because if they are then the Maoist-Democrat understanding comes to an end, and the global powers will resume their military aid to the SPA government. And Nepal will see a new round of war. Why would we want that? Why would the Maoists want that?

The Maoists don't have the option to pull a Lenin or a Mao. They don't have the option to use the democrats and the king against each other.

The king has finally come around to the constituent assembly idea. Why will the Maoists now want to abandon that plank? Because if they are going to organize a boycott of the Girija Koirala led SPA government, what message are they sending to the democrats?

I don't care much for the Maoist ideology, but there can be no compromise on human rights, not with the king, not with Prachanda. Prachanda is no royalty. He might as well not pretend.
But Maoist leader Prachanda said that the seven parties had committed "another historic mistake" and encouraged the people to continue their protests until the parties declared elections for an assembly to write a new constitution.
I think it is a welcome move on the part of Prachanda that he is cautious, that he wants to make sure there will be elections to a constituent assembly. But a blockade is not how you do that.

18 Days Of April Revolution: Victory

Prachanda should not try too hard to rain on the democrats' victory parade, or he makes that same constituent assembly less possible.

The Maoists have said they are going to continue blockading the capital city and the district headquarters. If this is their cynical way of suggesting the people came out in the streets because basic supplies went short, he is grossly mistaken. He is also being disrespectful of the people who came out into the streets. The people marched for freedom, not out of basic desperation.
