NAC Talk

I just visited the Alliance page, the Youth Council page and finally the NAC page hoping to find details for the symposium to be held this Saturday at Columbia University. The information has not been displayed. I wonder if the event is an in thing. Only a few people will get invited. I did get an info email from a friend in Texas a few weeks back, and I had an e-correspondence with one of the key organizers soon after. I got the impression it was an open meeting.

But then at the NAC page I noticed something of interest: Letter to President Jimmy Carter. I got told I got expelled from the Nepal Democracy Forum for going public with that letter. I knew that could not have been the reason, and now I stand proven by none other than NAC itself, not that I miss the Forum. It is too closed for me. I like things more open.

I proceeded to check out a few more items at the NAC page. This is vastly interesting: Exploratory meeting with HE Ambassador, Mr Kedar Bhakta Shrestha. This apparently happened a day or two before the royal coup. You got to notice the timing of it all. I sometimes wonder if the diaspora Nepalis are just a bunch of homesick people who talk of Nepal not necessarily with a service motive, but so as to bond among themselves. Because sometimes the attitudes, actions and comments are so off the mark. Look at some of the stuff.

He emphasized that the Diaspora, should forcefully communicate to the political entities of Nepal that if the political forces do not respond positively to well meaning calls for peace, they would lose the support of Diaspora. The Diaspora expects political entities in Nepal to respond responsibly, otherwise Diaspora could soon lose interest in Nepali affairs and the movement could lose steam. In the final analysis, the Diaspora should take a stance and expect Nepali political entities to respond accordingly.

Golley, what is this supposed to mean? I am at sea.

The Nepali diaspora social organizations are like America when only white men with a ton of land could vote. Some of the professionally accomplished individuals have formed a few clubs. Something is better than nothing, but one wishes the organizations would get more mass based.

Yesterday I got to spend some time with Dinesh Tripathi. This guy is so highly accomplished. He has been called the Arthur Kinoy of Nepal by the National Lawyers Guild, USA. But no Nepali organization in the city bothered to organize a talk program around him like for so many other lesser visiting Nepali dignitaries. (
Dinesh Tripathi In New York, Dinesh Tripathi: In Person) To me this is so obviously a Madhesi-Pahadi thing. He is so totally in the lead for the most important thing the diaspora could do for the movement in Nepal. If and when there is a need, he will be taking the lead for global legal action against the king and the army top brass. He has been doing the homework for it in concert with several of his Ameican colleagues. But it is like blacks fought on behalf of the US during World War II and came home to segregation.

Me? I fall in a slightly different category. I have no ambitions to climb the leadership ladders in the so many Nepali social organizations in the US, not my cup of tea. I am only interested in the democracy movement. And my work goes on through specific projects. But the occasional slights I do take offense at on behalf of the 13 million Madhesis in Nepal. If not me, who? I think more Madhesis need to feel that way.

All Nepalis in America are non-white, which is half way to black. But some of the most racist comments I ever heard have been from Nepalis, and I actually went to school in the South. What are you supposed to think, that these Bahuns are white! Golley.

I think a concerted effort has to be made to reach out to the tens of thousands of Nepalis in the US. Let people donate $10 and pose for group photos to express solidarity to the movement in Nepal.

At some level the organizational dysfunctions are also amusing, like biologists watching lizards or something. The Nepalis are a colorful bunch.

But the work of democracy is on, in both Nepal and in the US. That is the good news.

Mr. Krishna Nirola, President of ANA (Association of Nepalese in Americas) announced that a total of $22,000 (twenty two thousand dollars) had been collected for the families of Nepali victims of terrorist attack in Iraq. The families in Nepal had been identified and the money will be dispensed to those families. He thanked all contributors and coordinators of this valuable effort on behalf of ANA. This was welcomed with resounding satisfaction by the audience.

I wish the NAC did some fundraising also for the various projects. So far mum has been the word.

Dinesh Tripathi In New York

Date: Sun, 8 Jan 2006 12:44:23 -0500
From: "Dinesh Tripathi"

Subject: TALK ON NEPALI HUMAN RIGHTS IN NEW YORK

Dear Sir,

National Lawyers guild New York chapter has invited me to speak about human rights situation of Nepal. National lawyers Guild is umbrella organization of American lawyers, law professor'sand law academics. I am sending you a news report for publication. I hope it will be useful for your readers. Thank you.

With best regards
Dinesh Tripathi

TALK PROGRAMME ON NEPALI HUMAN RIGHTS IN NEW YORK

6 JAN. NEW YORK,

Advocate Dinesh Tripathi address the gathering of National Lawyers guild of New York chapter. On the occasion he spoke that---there is total non-existent of rule of law in Nepal. Although constitution is not formally with- drawn but it is totally violated and disregarded. There is massive violation of human rights law and International humanitarian Law from both sides. State has became arbitrary and there is state sponsor terrorism. King has no intention to restore democracy and peace that's why he totally disregarded and did not responded or reciprocated the cease fire declare by Maoist. Security forces is working with full impunity and without any accountability's. Death, disappearance and torture has became daily routine of the Nepali life. There is harsh censorship impose on the media. Black law have been introduce to suppress media freedom guaranteed by constitution. There is frequent mid-night attack on community radios which are ( FM ) the quickest source of information for common people. Economic blocked has also been impose on media. Journalist are facing frequent threat from the both sides. Several journalist have been arrested by government and killed by Maoist. Although political parties are not formally banned but they have been marginalinalize by king and without representation of valid party cabinet had been constituted under his own chairmanship which is blatant and clear violation of constitution. In the cabinet people who have no mass base and people who have been convicted by court had been inducted in the cabinet. Without people's support and popular legitimacy king is running a government which is the clear disregard of the cardinal principle of democracy that "No taxation without representation." Notion of independence of judiciary is also massively undermined. Court system is also working under the shadow of militarization. There is non-compliance with court order and court have been packed by pro-king people. Court is no longer able to uphold the supremacy of the constitution and liberty and dignity of the citizen.

In this critical and most critical juncture of our history and we need a active support and solidarity of International community. Struggle of human rights is global one and it is global issue. Violation of human rights and freedom is in one country should be considered the threat against all people and all nation. But Nepal has became a kind of forgotten country. International civil society and community must play a active role to establish a human rights and democratic peace in Nepal. International legal action is the need of the our in Nepal because national mechanism is failed and became ineffective to protect peoples rights and failed to made the human Right violator accountable. International criminal court must take up and it must be allow to assume it's jurisdiction on Nepal so massive violator and perpetrator of human rights could be face trial and impunity could be ended. International community can work in this issue.

National lawyers guild is umbrella organization of American lawyers, academics and judges. 1

Hi.

You must know Nepal is one of the three hot spots on the planet right now. There has been a civil war in the country for a decade now. And there is a decisive democracy movement on its way in the country that promises to restore both peace and democracy. Nepal also might figure in the US elections for 2006 and 2008 as the Democrats might offer the progressive way to spread democracy in the world to compete with the neocon way like in Iraq. The Nepal way might apply to the rest of the Arab world as well to China down the line.

Nepal needs to be hitting the world headlines for the news value itself, but also because the coverage will aid the democracy movement itself. As a country of 27 million brave people, Nepal deserves the spotlight.

So far there has been little or no coverage of Nepal in the world media. As a matter of fairness that needs to change. Your viewers have a right to get better informed. What happens to Nepal affects them.

The seven party alliance in Nepal is to hold major protest rallies on January 12 in Janakpur and on January 20 in Kathmandu so as to foil the fake municipality elections slated for February 8 by the illegitimate regime that has been in power since the 2/1 coup last year. The elections are supposed to earn it legitimacy from the unconvinced international community. I believe the world media needs to widely cover this showdown.

I hope I have managed to appeal to your journalistic instincts.

Thank you.

Sample Letters:

1. I sent this email to aaronbrown -at- turner.com:

Mr. Brown and fellow journalists,

I feel as a matter of fairness, equality, and journalistic ethics, CNN
should feature more coverage of the earthquake in Pakistan. While
tragedies such as the tsunami and Hurrican Katrina resulted in many
donations from individuals for relief for the victims, the recent earthquake
in Asia has not achieved nearly enough donations to take care of the
victims. After the initial earthquake and the recent aftershocks, so
many people are still sick and homeless.

After seeing the difference in the media treatment between other
disasters and this disaster, I cannot help but wonder if the news media,
and therefore the public, are discriminating against Pakistani citizens
because they are Muslim. I think this could be a story in itself for
CNN, and there is certainly enough newsworthy video footage.

Thank you,
Tracey Denton

2. I sent this message through the webform feedback at CBSNews.com. (Scroll down, click on "Contact Us," third button in the blue bar, and a window with a webform will open.)

Dear CBS News journalists,

As a matter of fairness, equality, and journalistic integrity, CBS News should be featuring more coverage of the earthquake and aftershocks in Pakistan that have left people homeless, sick, and facing a brutal winter. Surely it is important that your viewers see images of Pakistan before they see the image of Camilla Parker Bowles wearing a tiara on loan from Queen Elizabeth.

Yesterday, October 26, 2005, I clicked on the "World" section of CBSNews.com, expecting to find a story about how donations to the Pakistani earthquake relief efforts are not nearly high enough to help all the victims. This story should have been near the top of the list. Instead, it wasn't there at all. And yet, a picture of Camilla and Prince Charles at a royal banquet was front and center, because Camilla was wearing a diamond tiara - loaned by Queen Elizabeth II. I understand that your readers may in fact be interested in the internal workings of the Royal Family. But surely, with all the coverage you gave to victims of the Tsunami and Hurricane Katrina, it is only appropriate to include more coverage of the earthquake in Pakistan. Coverage in the media, especially with pictures, encourages more people to donate to relief organizations.

I cannot help but feel, after seeing the media's treatment of the Tsunami, Katrina, and the Pakistan earthquake, that there is a bias in the mainstream media because the victims are Muslim. This could be a news story in itself.

Sincerely,

Tracey Denton

Advisors, Doers, Donors, Supporters, Cheerleaders, Spectators, Whiners

I have been trying to create a group dynamics model that throws light on the commendable work on behalf of the democracy movement being done by the Nepali diaspora in the US. Here in the diagram is my latest attempt. One important addition has been the section at the top for the advisors. There are many well accomplished Nepalis who can not see themselves with one of the projects, because all that would be too hands on for them, and they are often holding various leadership positions in the various Nepali social organizations on the continent, and these might be people who will happily donate $1000 or more because they are in the top income brackets, but their contribution can not be measured in the number of hours they might have to give. They would be kind of like the Board of Advisors if this movement and projects to do with it were a company.

Diaspora Dynamics
The Cloud Model, Not The Pyramid Model

On the other hand, I do feel there is this urgent need to expand the involvement base. What about those tens of thousands of Nepalis who are also in the country? I think many of those could pose for group pictures to express their solidarity: Flickr Tag: NepalDemocracy. And they could each donate $10.

I believe the top and the bottom have been missing in all my earlier models. I have been too focused on the immediate. So let's close in from both ends.

I think it is so much easier to get along and stay focused and productive as long as we keep focused on the intended recipient of our work: the 27 million people in Nepal. It is not about us, it is about them.

This is also of career interest to me. I have been working within the Democratic Party in a so-far small capacity to present Nepal as the Iraq for the Democrats. There is a neocon way to spread democracy, and then there is a progressive way. The model we could develop for Nepal could be replicated elsewhere in the world. Suddenly the immigrants in America from all these poor countries become small scale heroes in America, as opposed to being people who are quick subjects of demonizations and scorn from the mainstream, sometimes subject to racial harassments and more. They get to transform and become the soldiers on the cutting edge for democracy. From being nobodies working little jobs, they become freedom fighters, part time. That would contribute to their sense of self worth, don't you think?

If we can become more organized and more effective than we are, we can also hope to get substantial logistical support from the private sector, as well as the public sector. We could be talking big bucks. Money helps. We could do more for the democracy movement in Nepal with more money.

I have constantly tried to come up with a model that will allow every interested individual and organization to contribute to the max. I think the latest model is close to it, and it builds on the earlier models.

My style is to suggest all of us should go public with our names and stay public with our names. If we can not show up in the streets of Nepal, that is the least we could do. But I am understanding of those who might choose to put in the work and the money, but keep their names private.

Earlier, much earlier I have talked of 5 Steps To Democracy.

Two layers could be added to that model.
  1. The diaspora could really take the lead.
  2. The international community could help proactively, by establishing and threatening with international laws that would make all countries subject to the human rights regime, and by staying ready to recognize democratic regimes once movements give birth to them.
The movement for democracy in Nepal could have impacts for the 2006 and 2008 elections in the US.
